FINNEGAN, Circuit Judge.
This case has been before this court on two prior occasions. The first appeal, decided in December 1948, and reported in 172 F.2d 601, reversed an order of the District 'Court which dismissed plaintiff’s cause of action for failure to state a claim on which relief could be granted. The complaint filed under the Jones Act, 46 U.S.C.A. § 688, sought damages for personal injuries sustained by plaintiff while working as a deckhand on the tug boat “Roche” of which defendant was owner.
