Appeal from an order of the Supreme Court (Kavanagh, J.), entered October 10, 2003 in Ulster County, which, inter alia, granted defendant’s motion for summary judgment dismissing the complaint.
This action arises in the aftermath of a title dispute between defendant and plaintiffs to two parcels of property in the Town of Rochester, Ulster County, which ultimately was resolved in plaintiffs’ favor (see Shawangunk Conservancy v Fink, 305 AD2d 902 [2003] [hereinafter Shawangunk II]; Shawangunk Conservancy v Fink, 261 AD2d 692 [1999] [hereinafter Shawangunk I]).
