Prohibition: Relators are the Missouri Public Service Commission, the Chief of Police and Board of Police Commissioners of St. Louis, the City of St. Louis, the State Highway Commission and the Acting Superintendent of the State. Highway Patrol and have sued in this court to prohibit respondent, Judge of the Circuit Court of Cole County, from proceeding further in a suit pending before him. That suit was filed in August, 1939, by fifty-eight plaintiffs who allege in their petition, among other things: that the purpose of the suit is to procure a declaratory judgment construing the Bus and…
