MEMORANDUM OF DECISION AND ORDER
GENE CARTER, Chief Judge.
This action arises from a land dispute in Cape Elizabeth, Maine, whereby Plaintiffs assert an interest in certain rights-of-way over Defendant’s land, including the use of a road, certain paths and trails leading to the beach, and the beach.
