We decide here a discrete but important question: whether the Director of the Office of Workers’ Compensation Programs (“DOWCP” or “Director”) within the Department of Labor is a proper respondent to a petition for review of a decision of the Benefits Review Board (“BRB” or “Board”) brought under section 21(c) of the Longshoremen’s and Harbor Workers’ Compensation Act (“LHWCA” or “Act”), 33 U.S.C. § 921(c),1 when the Director aligns himself with petitioner urging reversal of the Board’s order.
