In a complaint filed on May 28, 1965, the plaintiff, Thermal Dynamics Corporation of New Hampshire, brought an action for a declaratory judgment to determine its rights under a non-exclusive licensing agreement made on June 12, 1963, with the defendant, Union Carbide Corporation of New York. Plaintiff further sought to enjoin the defendant from “depriving the plaintiff of its license and from unlawfully extending its patent monopoly beyond the legitimate bounds thereof” [complaint] by reason of the June 12, 1963…
