Error to the Circuit Court for Anne Arundel County. The plaintiff in error was indicted for giving liquor to a1 minor in violation of the Act of 1858, ch. 55. To the indictment he filed a general demurrer, which was overruled. He then pleaded non cut, and the jury having rendered a verdict of guilty, he moved in arrest of judgment upon several grounds,, which, with the indictment, are fully set out in the opinion of this court.

At the April term 1858, of the Circuit court for Anne Arundel county, the plaintiff in error was indicted under the Act of 1858, ch. 55. The offence, as charged in the indictment, is:
“That Thomas Parkinson, late of said county, yeoman, on or about the fifth day of April, in the year of our Lord, eighteen hundred and fifty-eight, with force and arms, at the county aforesaid, within the corporate limits of the city of Annapolis, unlawfully did give a certain quantity of fermented liquor, to wit, one half pint of fermented liquor, commonly called ale, to Joseph W.
