MEMORANDUM AND ORDER
PAULEY, District Judge.
On November 4, 1998, Petitioner Vittoria Corporation (“Vittoria”) filed a verified petition in New York State Supreme Court seeking to stay an arbitration demanded by Respondents New York Hotel and Motel Trades Council and its president, Peter Ward (collectively, the “Council”) pursuant to a collective bargaining agreement. On November 5, 1998, the Supreme Court granted Vittoria’s application for a stay and scheduled a hearing for November 18,1998.
