MEMORANDUM OPINION

TOM S. LEE, District Judge.

This cause is before the court on the separate motions of the plaintiff, Flora *467Compress and Warehouse Company, Inc. and the defendant, United States of America, for summary judgment. The court, having considered the motions and briefs with attachments submitted by the parties, is of the opinion that the plaintiffs motion should be denied and that the motion of the United States should be granted.
