This is an original proceeding in the supreme court -wherein the Chief of Police of the City of Minot and the Police Magistrate of the City of Minot seek a review, by a supervisory writ of this court, of the action of Honorable A. J. Gronna, Judge of the District Court of Ward County, in issuing writs of habeas corpus and upon hearings thereunder discharging from custody of the chief of police, Arthur Helland and Thomas Smith.
