Following an ore tenus hearing, the Circuit Court of Winston County denied Polly Baker's motion for a declaratory judgment.

Mrs. Baker filed a complaint on April 27, 1984, against Neotha Townsend, Chris Baker, Randy Holt, Ricky Holt and Dolly Ann Sulsby (defendants). Mrs. Baker asked the court to find that a common-law marriage existed between Polly Baker and Odie Baker at the time of his death.
