TALIAFERRO, Judge.

Plaintiff, a member of defendant’s building crew, was injured while in the discharge of his duties. He sues to recover damages. Defendant is engaged in interstate commerce. Plaintiff was injured while performing services on its main line; therefore, his suit was brought under and is governed by the Federal Employers’ Liability Act, 45 U.S.C.A. §§ 51-59, and the rights and liabilities of the parties thereto must be measured and determined by its provisions.
