It is maintained that an error was committed in refusing to grant a judgment on the pleadings in favor of the plaintiff, on the ground that the denial in the answer of the “allegations of facts contained in paragraph 5 of the amended complaint” is insufficient amounting to an admission of the averments of that clause.
