FIELD, Chief Judge.

In this action the plaintiff, Francis C. Perkins, was awarded a jury verdict in the sum of $25,000.00. The defendant has filed its motion under Rule 50 (b) for judgment n. o. v. or in the alternative for a new trial.

The facts material to a disposition of these motions are briefly as follows: Defendant, Kaiser Construction Company, was general contractor for the erection of the plant of Kaiser Aluminum and Chemical Company at Ravenswood, West Virginia.
