The record and arguments in this action forcibly impress upon our minds the fact that the average action to recover damages for injuries alleged to have been caused by negligence is, so to speak, a mine, in which the inducements to dig and search for error are exceptionally enticing and often prove irresistible to ingenious and acute counsel.
