ORDER DENYING DEFENDANT’S MOTION TO DISMISS AMENDED COMPLAINT

This proceeding is before the Court on Defendant United States Department of Agriculture’s (“Defendant”) Motion to Dismiss Plaintiff Neil F. Luria’s Amended Complaint (Doc. 20, “Motion to Dismiss”; see also Doc. 11, “Amended Complaint”), Mr. Luria’s response in opposition thereto (Doc. 24, “Response”), and Defendant’s reply brief (Doc. 25, “Reply”). For the reasons stated herein, the Motion to Dismiss (Doc. 20) will be denied.
