1. Coachman sued Knowles upon a promissory note, in a justice’s court. The magistrate rendered a judgment in favor of the plaintiff The defendant appealed the case to a jury. The jury found a verdict in favor of the defendant, and judgment was entered accordingly. The plaintiff took the case by certiorari to the superior court, and upon the hearing in that court the judge sustained the certiorari, set aside the judgment of the court below, and rendered a final judgment in favor of the plaintiff; whereupon the defendant excepted.
