Plaintiffs, Debbie Lynn Massey, Pam Ponder, Mary and Miles Johnson, Edna Higgins, and Dewayne Higgins, filed an action against Life Insurance Company of Alabama (hereinafter "LICA") and Cecil Miller, the chief executive officer of the former First National Bank of Jacksonville, Alabama (hereinafter "Bank"). The complaint alleged fraud, money had and received, and conversion and made other allegations whose merits are not sufficiently presented on this appeal.
