This is a criminal'prosecution wherein the appellant was charged by indictment with the unlawful sale of intoxicating liquor to one Winnie Kirkpatrick, in violation of §2717 Burns 1926.

Appellant filed a motion to quash the indictment, which motion was overruled and thereafter a plea of not guilty was entered. The case was tried before the jury and a verdict rendered that the appellant was guilty as charged. The court pronounced judgment on the verdict.
