On December 18, 1933, Mrs. David I. Parnell instituted this action in the city court of Albany against North *180British and Mercantile Insurance Company. The action was founded on a contract of fire insurance upon a certain house in the principal amount of $2000, issued originally by the defendant to the estate of Mrs. Celem Crawford in August, 1932, and by proper endorsement transferred to the plaintiff on January 18, 1933. The plaintiff’s petition alleged the destruction of the property insured by fire, sometime during 1933, and prayed for a judgment in the sum of $2000, plus a penalty of 25%,…
