— This is a case of first impression in this court. Plaintiff claims that in 1868, when she was about a year old, her father made an oral contract with O. P. Johnson and wife, whereby the father turned plaintiff over to them and surrendered his rights as a father, in consideration of which the Johnsons agreed to legally adopt *368plaintiff and make her their heir and upon their death leave her all their property.
