PHASE 1 FINDINGS OF FACT AND CONCLUSIONS OF LAW

ARTERTON, District Judge.

Because there are two potentially dis-positive factual issues in this ERISA case, the Court and the parties agreed that an evidentiary hearing (Phase 1) would be held in lieu of summary judgment motion practice as the more expeditious course. What follows are the Court’s findings of fact and conclusions of law on these two issues, related to statute of limitations and the sufficiency of plaintiffs inquiry to trigger defendants’ informational response duty.
