OLIVER J. CARTER, District Judge.

The United States, on January 29, 1951, filed a complaint in condemnation taking the temporary use and occupancy of the Flood Building, a twelve-story office building located at 870 Market Street, in San Francisco, California.. The government, needing the space for the housing of federal agencies, took possession the following day.

It appears that the upper ten floors of ■the building, constituting about 168,000 square feet of office space, were practically empty on the date that the government filed its complaint. The reason for this is that the owners of the…
