COCHRAN, District Judge.

This is a suit in equity to quiet the title to a tract of land in Harlan county, Ky., containing 40,400 acres. The plaintiffs’ claim thereto is based upon a patent issued November 4, 1873, C. O. Kockhard, their devisor. It is set forth in the bill and filed as an exhibit therewith.* Certain of the defendants have demurred, and certain others have answered, and to a portion of the answers the plaintiffs have filed exceptions. The ground of demurrer is also relied on in said portion of the answers, so that the demurrers and exceptions raise the same questions.
