John Garvin, trustee and stockholders’ agent, one of numerous defendants in a mortgage foreclosure proceeding pending in the circuit court of McLean county, has appealed from a summary judgment entered against him and in favor of plaintiff in the above cause. The plaintiff appellee, J. F. Shepard, had filed a suit in equity to foreclose a first mortgage real estate lien given to secure payment of a promissory note in the principal sum of $7,000, by Lewis 0. Wheaton and Minnie A.
