The People bring this interlocutory appeal pursuant to C.A.R. 4.1 to challenge a suppression ruling made in the course of a pending criminal case -in which the defendant, Thomas Titus (Titus), was charged with possession of marijuana with intent to distribute or sell1 and possession of marijuana.2 The trial court ruled that the affidavit underlying the warrant to search Titus’ residence did not establish probable cause, and suppressed the evidence seized during the search.
