GODBOLD, Chief Judge:

This case involves a taxpayer who arranged to plant drugs on an IRS auditor and filed false complaints with the IRS in order to discredit the auditor and hinder an investigation. Count I charged that the defendant:

*1406knowingly, willfully, and intentionally did attempt to possess with intent to distribute a controlled substance, to wit, marijuana, a Schedule I controlled substance, and cocaine, a Schedule II controlled substance, in violation of Title 21, United States Code, Sections 841(a)(1) and 846, and Title 18, United States Code, Section 2.
