In this interlocutory appeal, we consider a facial First Amendment challenge to a regulation banning leafieting and other “demonstration activities]” on the sidewalk at the foot of the House and Senate steps on the East Front of the United States Capitol. Finding that the sidewalk is a public forum and that no part of the ban is narrowly tailored to further a significant governmental purpose, we declare the ban unconstitutional.
