The plaintiff alleges that it employed the defendant’s testate, one Chase, a civil engineer, to perform certain engineering work in connection with the survey and plotting into building lots, with roads and reservations, of a large tract of land owned by it; that Chase undertook the performance of this work and was paid therefor, but that he failed to do the work in a skilful and proper manner; and it seeks to recover damages either in contract or tort.
