MEMORANDUM OPINION

On April 11, 2003, the Court held a hearing on a Motion for Summary Judgment by Atlanta Casualty Company (“Defendant”). The Court was asked to determine whether actions taken by and statements made by Douglas McArthur Byrd, Sr. (“Plaintiff’) and Patricia Rose Byrd violated provisions in Defendant’s automobile insurance policy covering Plaintiff and Mrs. Byrd’s 1999 Chevrolet S-10 Blazer (“1999 Blazer”), so that as a matter of law, Defendant was not obligated to pay Plaintiff for the loss of the 1999 Blazer.
