Before the court is a motion to dismiss filed by the defendant, Christopher K. Zemba. The motion filed by the plaintiff Marvin Wilson, Jr., to substitute Tymar Wilson as plaintiff and request to amend *543the complaint arise out of the filing of the motion to dismiss and represent an attempt to avoid it. As will be discussed, the motion to dismiss argues that the court has no subject matter jurisdiction over the present case because the complaint identifies the parent, Marvin Wilson, Jr., as the plaintiff and not the minor child, who is named Tymar Wilson.
