The defendant in error sued the plaintiff in error in the law court at Bristol for damages arising out of the death of her husband, alleged to have been caused by the negligence of the plaintiff in error.

*373After tbe evidence, on both sides bad been submitted to tbe jury, tbe plaintiff in error asked tbe court to give tbe jury a peremptory instruction in its favor. Tbe defendant in error thereupon asked tbe court to instruct the jury in her favor, except as to tbe amount of damages, which she asked to be submitted to the jury.
