On December 5, 1892, the prosecuting attorney filed in the district court an information charging plaintiff in error with having kept open a saloon for the sale of liquors on the Sabbath day, in the county of Arapahoe, in this state. A trial was had, resulting in a conviction and sentence to pay a fine of $100, and to stand committed until the fine was paid. The finding as to the facts and the guilt of the party are not questioned.
