The defendant, Charles E. Fuller, Jr., appeals from his conviction of murder in the first degree, and from the denial of his motion for anew trial. On appeal, the defendant asserts that the judge should have allowed his motion for a required finding of not guilty. See Mass. R. Crim. P. 25, as amended, 389 Mass. 1107 (1983).
