This is an appeal from a final order dismissing appellant’s complaint in equity for failure to allege a cause of action.
The facts alleged in the petition and in the motion to dismiss necessary to an understanding of the contentions of the parties may be stated briefly. The appellant is a body politic and corporate created by Act 97 of the General Assembly of Arkansas in 1905 for the purpose of protecting the lands of the levee district from the overflow of the Red River by the construction and maintenance of a levee.
