OPINION

SETO, Judge:

This action comes before the court on defendant’s motion for summary judgment. Plaintiff, Penn Towne Builders, Inc., (“Penn Towne”), a corporation engaged in general contracting work in New Jersey, seeks a judgment against the United States for $70,000 plus interest as payment for construction work assertedly performed on a housing project financed pursuant to § 236 of the National Housing Act, 12 U.S.C. § 1715z-l.
