This is an action of assumpsit, instituted in the district court of Wailuku, Maui,- for the recovery of $241.10, which is alleged in the declaration to have been deposited by the plaintiff with the defendant’s intestate for safekeeping. From the district court the case was appealed to the circuit court of the second circuit. Trial was had in the latter court without a jury.
