Introduction
Plaintiff Levert Lyons (“Lyons”) sued defendant Nike, Inc. (“Nike”) for infringement of United States Patent No. 5,513,-448 (“the '448 Patent”), issued to Lyons by the United States Patent & Trademark Office in 1996. Nike responded with counterclaims seeking declaratory judgments that the '448 Patent was invalid and that Nike had not infringed the '448 Patent.
