The plaintiff W. T. Daniel, whose property, movable and immovable, was being advertized for sale by the defendant J. B. Thigpen, Sheriff, under execution of a moneyed judgment against him and in favor of the defendant First National Bank of Arcadia, dated December 6, 1935, and wherein the bank’s mortgage and chattel mortgage affecting the property were recognized and ordered enforced; jointly with his wife and co-plaintiff, Mrs. Pearl Owens Daniel, instituted this proceeding, claiming their right to have exempt from the seizure and sale a homestead consisting of two mules…
