Petitioner Carlo Raimondo (Raimondo) sought a writ of habeas corpus (Ill. Rev. Stat. 1979, ch. 65, par. 1 et seq.) ordering his release from the custody of the Illinois Department of Mental Health and Developmental Disabilities (the Department). The Department has maintained custody of Raimondo since 1975 pursuant to a criminal court order which committed him following a finding he was not guilty by reason of insanity (Ill. Rev.
