The evidence discloses that the plaintiff was driving his automobile along the single track used by the defendant company in or near the middle of Milledge avenue, in Athens, Georgia. The machine was “astride” the rail on the right side of the plaintiff as he progressed along that street in a southerly direction; that is, the two wheels on the right side of the machine were outside of the rail, nearest the right side of the street, in the direction in which the plaintiff was going, and the two wheels on the left side of the machine and of the plaintiff were between the rails.
