—Appeal by the *466People from an order of the County Court, Nassau County (LaPera, J.), entered March 26, 2002, which granted the defendant’s motion pursuant to CPL 330.30 to set aside so much of a jury verdict as found him guilty of criminal possession of a weapon in the third degree and ordered a new trial on that charge.

Ordered that the order is reversed, on the law, the defendant’s motion is denied, the verdict is reinstated, and the matter is remitted to the County Court, Nassau County, for sentencing on the conviction of criminal possession of a weapon in the third degree.
