*1248Appeal by the People from so much of an order of the Supreme Court, Kings County (D’Ernie, J.), entered February 4, 2009, as granted that branch of the defendant’s motion pursuant to CPL 330.30 which was to reduce his conviction of murder in the first degree to murder in the second degree.

Ordered that the order is affirmed insofar as appealed from.
