The cause was tried to the court upon an agreed statement of facts. The matter concerns three principal parties, the plaintiff subcontractor Castle Concrete Co., hereinafter called “Subcontractor”, the defendant general contractor Fleetwood Associates, hereinafter called “General Contractor”, and the defendant legal title holder the American National Bank & Trust Company of Chicago as Trustee and the sole beneficiary thereunder, Arthur Zaltzman, hereinafter called “Landowner”.
