This case comes before the court under unusual, and somewhat peculiar circumstances. The prisoners at the bar were indicted for the murder of Elizabeth Holder, on the night of the 31st July 1842. The 5th October following they were arraigned and tried, and after a patient and protracted investigation, the trial resulted in a verdict of murder in the first degree. A motion was made for a new trial, which was overruled, and on the 15th October the court proceeded to sentence the prisoners.
