This suit originated in the justice court, and in due course was appealed to the county court; thence to this court. Appellee D.C. Herndon Co. sued appellant, Stuyvesant Insurance Company, to recover an unearned premium on a fire insurance policy. Appellee Mechanics' Insurance Company of Philadelphia was also a party defendant. A trial to the court without a jury resulted in judgment for D.C. Herndon Co. against appellant, Stuyvesant Insurance Company, and judgment in favor of appellee Mechanics' Insurance Company.
