There are presented for our determination separate questions of law raised by both defendants to the statement of claim filed in this action by plaintiff.

The statement of claim avers, inter alia, that on October 1,1938, the automobile owned and operated by defendant Crabtree injured Samuel C. Coates, Jr., a police officer in the employ of plaintiff city, that defendant insurance company insured defendant Crab-tree against such public liability; that on October 2, 1938, Crabtree notified the insurance carrier, defendant, of this accident claim; and that the latter, in accordance…
