OPINION AND ORDER

REBECCA BEACH SMITH, District Judge.

This limitation of liability case is before the court on three motions filed by claimant John L. Wiley: a motion to dismiss, a motion to dissolve the injunction issued by this court and to stay the federal proceeding, and a motion to increase the limitation fund. For’ the reasons stated below, claimant’s motion to dismiss is DENIED, and the motion to dissolve the injunction and stay the proceedings is GRANTED.
