DAVISON, Justice.

The parties to this appeal occupy the same relative positions as in the trial court and will be referred to as they there appeared.

Plaintiffs (William S. Murphy and Lillian Murphy) filed suit to quiet their title to a Vie interest in the oil, gas and other minerals in and being produced from a quarter section of land in Lincoln County, Oklahoma, and if failing in this,, then for an alternative judgment for the consideration paid for such interest in the amount of $500. There was no allegation or prayer for cancellation or rescission of the mineral deed by which plaintiffs…
