As is evident from the foregoing, this appeal is based upon a single assignment of error which challenges the propriety of the order sustaining the defendant’s motion for a new trial. January 1, 1932, at about 6 o’clock p. m., the plaintiff, as a nonpaying guest of the defendant, was riding in his automobile on a journey from the city of Portland through the town of Beaverton.
